Your Favorite Fall Memory

CONTEST BEGINS AT 12:00:00 AM (PT) ON October 1, 2012 AND ENDS AT 11:59:59 PM (PT) ON October 31, 2012 (THE "PROMOTION PERIOD").

HOW TO ENTER: Membership to www.deviantart.com (the "Contest Site") is required to enter the Contest. Membership to http://www.deviantart.com is free. If Entrant is already a registered member, Entrant is not automatically entered into the Contest. Entrant must be at least 18 years old as of October 1, 2012. Contest is void where prohibited by law.

Entrant must follow the instructions on Contest Site and submit the completed entry of a piece of artwork in the form of a diorama depicting a favorite memory of fall (The "Work").

The completed entry ("Work"):

must be a diorama in a shoebox or in a box of the dimensions of a shoebox as specified in the Construction Guidelines at the Contest Site and in the Contest Article;
must represent a favorite memory of the fall season experienced by the Entrant or as interpreted by the Entrant ("fall" is the season between September and December in the Northern Hemisphere of the globe);
must be capable of transport by mail without significant damage to the Work if the Work is a winning entry;
all items used in the Work may originate in any medium provided the medium is safe for international transportation through the mails;
for consideration as an Entry, the Work is to be photographed by the Entrant in up to four images in a single PNG or JPG file submitted only as a single deviation (the "Entry Photography"). Your layout, with the four images, can follow any style you wish following the Photography Guidelines at the Contest Site and in the Contest Article;
may not contain stock images obtained from other members of deviantART or other companies, however the following are acceptable: 1) licensed fonts 2) licensed stock brushes 3) licensed textures and 4) small three-dimensional objects which are not the central focus of the Work and which are purchased or made by another person; and
must be entirely the original work of the Entrant however the Entrant may use another person to create the Entry Photograph of the Work for the purpose of the submission to the Contest.

The Entry Photograph of the Work must be submitted to the Contest Gallery found on the Contest Site in the form of a single PNG or JPG file consisting of up to four views of the diorama following the Photography Guidelines. Only online entries will be accepted. No hard copies of the entry will be accepted. Do not submit original files or the original diorama. ENTRIES MUST BE RECEIVED BY 11:59:59 PM (PT) October 31, 2012. No illegible, incomplete, forged or altered entries will be accepted. Entrants may enter as many Works as they like however duplicate entries are not allowed.

Prize winning Works must be sent to deviantART's Los Angeles, CA offices after the announcement of the winners. DeviantART will pay the full cost of shipment by a carrier of deviantART's choice. Prize winning Works will not be returned to the winner and will be used for public display by deviantART and/or Wolverine at places of their selection at their discretion.

Entry Photographs will not be returned.
The Work (i) must be the exclusive original work of the entrant (other than small three-dimensional objects which are not the central focus of the Work and which are purchased of made by another person) and made for the Contest; (ii) must be in keeping with the image of deviantART and Merrell; (iii) may not be libelous or defamatory, pornographic, sexually explicit, unlawful or plagiarized, as determined by the deviantART and/or Wolverine World Wide, Inc ("Wolverine" the parent company of Merrell) in their sole discretion; (iv) must not be harassing, abusive, profane, obscene, excessively violent, racially, ethnically or sexually objectionable or similarly offensive in any way, as determined by deviantART and/or Wolverine in their sole discretion; (v) may not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights, or involve in the making of the Work physical harm to any person or animal; (vi) may not contain commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans; (vii) may not include any viruses, worms, corrupt files, Trojan horses, or other forms of corruptive code or content that may harm or compromise the Contest Site and/or the proper conduct of the Contest; (viii) may not use any water marks or large distinguishing artist marks (such as any prominent signature or symbol representing the artist) however a small signature is acceptable if removable; and (ix) if found to be in violation of these rules will be disqualified and therefore removed from the Contest Site Gallery.
By submitting the Entry Photograph of the Work, Entrant represents that (i) (s)he has the unrestricted right to submit the Work and the Entry Photograph; (ii) all persons whose name or likeness appears in the Work have unconditionally consented in writing to their appearance in the Work and the Entry Photogrpah and unconditionally granted entrant in writing the right to submit the Work subject to these Official Rules, a copy of which consent and grant will be furnished to deviantART upon request; (iii) the Work does not infringe upon any third party's proprietary or other rights. Entrant may use 1) licensed fonts, 2) licensed stock brushes, 3) licensed textures and 4) small three-dimensional objects which are not the central focus of the Work and which are purchased or made by another person; and (iv) if Entrant uses a third party to make the Entry Photograph, the photographer has granted Entrant all rights necessary to use the photographs as part of this Contest and to permit their use as contemplated by these Official Rules.
All Works submitted will remain the exclusive property of the Entrant, provided that:

during the Promotion Period, and for a period of one year thereafter, eligible Entry Photographs of Works submitted to the Contest may be posted at the Contest Site or otherwise displayed in selections made by deviantART and/or Wolverine, and in any form and media on or off the deviantART site, but only in connection with promotion of the Contest and/or with reference to the Contest;
during the ten (10) year period immediately following the Promotion Period (the "Display Period"), deviantART, and/or Wolverine may (but will not be obligated to) display prize winning Works and/or Entry Photographs of the prize winning Works in any form and media in connection with the promotion of their respective businesses;
Entrant acknowledges that deviantART and Wolverine may change, crop or otherwise alter any Entry Photographs of the prize winning Works for the purposes of its use and /or display including the placement of their respective logos and/or company names;
deviantART, and/or Wolverine may otherwise use prize winning Works in such manner and upon such terms and conditions as the relevant entrant may approve in writing (such approval not to be unreasonably withheld, delayed or conditioned);
Entrant may not authorize or permit any prize winning Work to be used to promote any product or service of any party other than Entrant, deviantART and/or Wolverine during the Display Period;
Prize winning Works must be sent to deviantART's Los Angeles, CA offices after the announcement of the winners. DeviantART will pay the full cost of shipment by a carrier of deviantART's choice. Prize winning Works will not be returned to the winner and will be used for public display by deviantART and/or Wolverine at places of their selection at their discretion.

SELECTION OF WINNERS: Potential winners will be selected on or about Wednesday the 7th of November, 2012, from all eligible and qualified entries. Twenty-five (25) finalists will be selected by full-time deviantART Staff on the basis of (1) Creative use of the shoebox space; (2) Overall Impact of the Work; (3) Successful Interpretation of the Theme; (4) and Technical Skill. One Grand-Prize Winner and the Second and Third Place Winners will be selected from the twenty-five semi-finalists by Merrell staff. Only one entry per entrant may be chosen as a Finalist. The judges' decisions are final on all matters relating to the Contest. In the event of a tie in any portion of the judging process, the judges themselves will resolve the tie to the appropriate number of semi-finalists or ranked winners as applicable. Judging of the winners will be based on (1) Creative use of the shoebox space; (2) Overall Impact of the Work; (3) Successful Interpretation of the Theme; (4) and Technical Skill in whatever degree the judges believe to be appropriate in reaching a decision. The First, Second and Third Place Winners will be required to make their original diorama available for shipment to deviantART at deviantART's expense. Any failure to make the diorama available for delivery in exactly the form in which it was photographed for the Entry Photograph will result in dis-qualification and substitute winner will be chosen.
PRIZES: There will be twenty-two (22) Finalist Prize Packages, one (1) First Place Winner Prize Package, one (1) Second Place Winner Prize Package, and one (1) Third Place Winner Prize Package.

One (1) Grand-Prize Winner will receive: $2,500 USD, a trip to attend a deviantMEET in either Portland, OR or Seattle, WA, U.S.A. on March 16, 2013, a pair of shoes from the Merrell Vendemmia Collection (depending on sizes and availability) a Nintendo Wii U (Deluxe Set), 6,000 deviantART Points, a dA PRO Digital Artist Backpack, a Print of Winner's choice (from http://shop.deviantart.com/ up to a maximum of $250), and a One-year Premium Membership to deviantART. Approximate Retail Value ("ARV"): $6,795.00 USD. Actual value may vary.

One (1) Second Place Winner will receive: $2,000 USD, a Nintendo Wii U (Basic Set), 2,000 deviantART Points, a dA PRO Digital Artist Backpack, a deviantART Gear T-Shirt of winner's choice (depending on availability), and a six-month Premium Membership to deviantART. Approximate Retail Value ("ARV"): $2,450.00 USD.

One (1) Third Place Winner will receive: $1,000 USD, an Apple iPod Nano (16 GB, Silver), 2,000 deviantART Points, dA PRO Digital Artist Backpack, deviantART Gear T-Shirt of winner's choice (depending on availability), and a six-month Premium Membership to deviantART. Approximate Retail Value ("ARV"): $1,300.00 USD.

The twenty-two (22) remaining Finalists will each receive: $50 USD iTunes Gift Card, a deviantART Gear T-Shirt of winner's choice (depending on availability), 800 deviantART Points, and a three-month Premium Membership to deviantART. Total Approximate Retail Value ("ARV") of each Finalist Prize Package: $82.50 USD. Grand-Prize winning entrant acknowledges that the trip package is for the purpose of viewing the Grand-Prize winning Work and accordingly entrant will make his or herself available to Sponsor during his or her stay in Portland, OR or Seattle, WA, U.S.A. for publicity and to attend a deviantMEET. Entrant will be solely responsible for any visa or other special travel documents required if the entrant is travelling from outside the United States. DeviantART cannot provide assistance with respect to visas or government required travel documents. Trip package includes: (A) round trip coach-class airfare to Portland, OR or Seattle, WA, U.S.A for one (1); (B) two (2) nights accommodations at a hotel determined by deviantART in its sole discretion (single room, double occupancy); (C) ground transportation to and from the airport and the hotel by a carrier of deviantART's choice; and (D) a cash per diem of $50 for each of the two days stay. Transportation is from a major airport near Winner's home (as determined by deviantART in its sole discretion). Travel must be round trip. DeviantART will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions of these Official Rules, and those of deviantART's airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Travel restrictions, conditions and limitations may apply. If in the judgment of deviantART air travel is not required due to winner's proximity to prize location, ground transportation will be substituted for round trip air travel at deviantART's sole discretion. DeviantART will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Grand-Prize Winner will not receive the cash value of the trip in lieu of traveling. If the Winner is unable to travel as needed for the deviantMEET as scheduled, then the trip package will be rescinded. There will be no equivalent cash or other prize made available to Winner if the winner cannot travel as required or if the trip is otherwise forfeited.

Odds of winning depend on number of eligible entries received and nature of Work. All prizes will be awarded (assuming sufficient number of entries). DeviantART reserves right to substitute prizes of equal or greater value. No other substitution or transfer of prizes permitted. DeviantART is responsible only for prize delivery; not responsible for prize utility, quality or otherwise. Taxes and fees, if any, are the sole responsibility of prize winners. DeviantART will not replace any lost, mutilated or damaged prizes.
ELIGIBILITY: Contest open to deviantART members who are at least eighteen (18) years old as of October 1, 2012, except employees and volunteers (and their immediate families and members of the same household) of deviantART and/or Wolverine World Wide, Inc., their affiliates, agents, judges and advertising and promotion agencies. There is no charge for deviantART membership.
VERIFICATION OF WINNERS AND DELIVERY OF PRIZES: Potential winners who are under the age of majority in their jurisdiction of residence and their parent or legal guardian will, and other potential winners may, be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release. Prize may be forfeited if affidavit or releases are not returned within 14 days after mailing to potential winner or if prize notification letter or prize is returned as undeliverable. Winner agrees to deviantART's use of his/her name, address, likeness, and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law.
GENERAL: This Contest is void where prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. This Contest will be governed by the internal laws of the State of California, USA. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the State of California. DeviantART and judges not responsible for late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due, incorrect or misdirected entries, mail or communications, for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. DeviantART and judges not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's e-mail account to receive e-mail messages. DeviantART disclaims any liability for damage to any computer system resulting from participation in, or accessing, posting, uploading or downloading information in connection with, this Contest, and reserve the right, in their sole discretion, to modify, cancel, terminate or suspend this Contest should any virus, bug, technical failures, unauthorized human intervention or other causes beyond deviantART's reasonable control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In the event of any such cancellation, termination or suspension, a notice will be posted on the Contest Site and the winners will be selected from among all eligible entries received prior to such time. DeviantART reserves the right, in their sole discretion, to disqualify any entrant from this Contest or any other promotion conducted now or in the future by deviantART or any of its affiliates if the entrant's fraud or misconduct adversely affects the integrity of the Contest. By participating in this Contest, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the judges and warrants that s/he is eligible to participate in this Contest.
